HC bins order cancelling UPP radio operators’ recruitment
Lucknow: The Lucknow bench of Allahabad high court has set aside the Jan 8 order of a single judge whereby it had quashed the selection process started on Jan 6, 2022, in which degree holder engineers were also allowed to participate in the selection process for these posts .
The court upheld that under the UP Police Radio Subordinate Service Rules 2015, only diploma holder engineers are entitled to apply for appointment to the post of head operator/head operator (mechanic). Under these rules, degree holder engineers are not eligible to apply for the post.
A two-judge bench of Justice AR Masoodi and Justice Subhash Vidyarthi passed the order allowing the special appeal filed by Prashant Kumar Mishra and others who had challenged the single judge verdict.
The single judge had on Jan 8 held that degree holder engineers had no right to apply in pursuance to the advertisement issued for appointment in police radio recruitment but they were illegally allowed and hence the entire process got vitiated. The single judge had set aside the entire selection process.
The two-judge bench agreed with the single judge that degree holders were not entitled to apply for the recruitment but said that since the orders of Police Establishment Board to allow these degree holders to apply for these posts had no legal value, the order of single judge setting aside the entire selection process is erroneous and hence is set aside.
