No HC relief for woman who took home loan using different names
Mumbai: Bombay High Court on Monday dismissed a petition by a woman who took a home loan from the State Bank of India (SBI) under different names and claimed she was wrongly accused due to the similarity of names.
Justices Revati Mohite Dere and Neela Gokhale dismissed a 2021 petition by Deepa Somaji Palkar for a special investigation team (SIT) to investigate the FIR registered by Ghatkopar police on an April 2015 complaint by SBI, Ghatkopar (W) branch, naming her as an accused.
She alleged that Santosh Palkar, alias Santosh Palakar, "who was arrayed as her purported husband," took advantage of the similarity of her name with that of his real wife, Deepa Santosh Palkar, and defrauded banks. She was shown as the principal borrower of housing loans that were disbursed in her account. She never sought these loans and was unnecessarily dragged into criminal proceedings.
On Dec 18, the High Court was told that an investigation by senior inspector Avinash Kaldate revealed that Deepa Somaji Palkar and Deepa Santosh Palkar are one and the same person and "the petitioner... used the aforesaid names in different forums."
On Feb 5, the judges took note of Kaldate's Jan 17 affidavit that the petitioner's Feb 2015 home loan application form, IT returns, and bank statement showed her name as Deepa S Palkar, Deepa Palkar, and Deepa Somaji Palkar. Even the photograph on the application form was of the petitioner.
After HC's Sept 25 order, she had submitted her Aadhar card, PAN card, and passport for verification. These documents were self-attested. The customer application form was filled as Deepa Santosh Palkar, and her father's name was written as Somaji Sidhram Palkar. The judges said the investigation revealed the petitioner submitted documents for obtaining a home loan from SBI in different names — Deepa S Palkar and Deepa Santosh Palkar — and the latter's address was bogus. "Thus, there is no substance in her grievance and the FIR correctly names her as accused," they concluded.
