Non-compliance: Court asks treasury to halt B’sarai DM’s salary
Begusarai: A sub-divisional court has asked the treasury to withhold the salary of the Begusarai district magistrate until further notice. Teghra sub-divisional court munsif magistrate Shailendra Kumar has also ordered the district treasury officer to file an affidavit regarding compliance with the court's directive. The order, issued on Tuesday, follows the district administration's failure to implement a title execution suit ruling passed in Sept last year.
The case pertains to a Patna high court order in March 2014, which directed that Shyamdev Prasad Singh — the petitioner and decree holder in the Shyamdev Prasad Singh vs. Dularu Singh land dispute case — be given possession of his land within a stipulated period. However, even after 10 years, Shyamdev has not received possession of his land. As a result, he filed a title execution suit in the Teghra court.
Despite this, the survey knowing pleader commissioner reported to the sub-divisional court in Sept that the magistrate and police force were not cooperating in enforcing the court's order. Based on the report, the court directed the DM and SP in Dec last year to submit a report on the matter, but no response was received.
The SP, however, eventually filed a report on Jan 25, but the court deemed it unsatisfactory and scheduled the next hearing for Feb 19. The court also expressed concern over the fact that the petitioner had personally paid Rs 49,015 to cover the expenses for the deployment of a magistrate and police force. Despite this, the district administration has failed to execute the order even after such a prolonged delay.
