New Delhi: Municipal Corporation of Delhi (MCD) on Wednesday said that recently the Delhi High Court held that the process adopted by the MCD in the allotment of a parking lot was fair and transparent.
"The Delhi High Court said that as per the terms of the licence agreement, the allotment was for a period of three years and on the expiry of this period the licence automatically terminated," MCD said in a statement.
According to MCD, the Delhi High Court rejected the petition filed regarding the extension of the licence of a parking space in the City SP Zone.
"The petitioner claims that in the year 2021, the MCD issued a tender for the allotment of surface parking sites on a monthly licence fee. The bid of the petitioner was accepted and the parking space was allotted to the petitioner via a letter dated December 31, 2021," MCD said.
It added, "As per the terms of the contract, the allotment was to be for a period of three years starting from January 1, 2022, to December 31, 2024. The petitioner claims that the licence agreement was for a period of four years and there was a provision for the extension of the licence for a period of one year after the expiry of the initial three years on the same terms and conditions with a licence fee of 10 per cent. The petitioner claimed that the Municipal Corporation of Delhi arbitrarily rejected the request for licence extension."
On the other hand, MCD said, "The petitioner had no inherent right to ask for an extension because granting an extension was entirely based on the discretion of the MCD."
"The High Court held that the process adopted by the Corporation was fair and transparent. Such methodology adopted by a public authority has been approved by the courts subject to it being fair and transparent," said MCD.
