Local dealership ordered to stop selling cars in Kansas
WICHITA, Kan. (KSNW) — A local car dealership has been ordered to stop selling cars in the state of Kansas.
According to the Sedgwick County District Attorney’s Office, a $394,197 default judgment was entered against Kayode Ajibolade and his dealership, Carnation LLC, for “engaging in deceptive acts and willfully violating a previous consent judgment under the Kansas Consumer Protection Act.”
According to the Consumer Protection Division, Ajibolade failed to disclose that a car had blown airbags before selling it to a consumer. After the consumer bought the car, they found an airbag simulator device that disabled the airbag light on the dash. The CPD also found that Ajibolade and Carnation sold 12 more cars with blown airbags in the first quarter of 2023 without telling the consumers at 1301 E. Lincoln.
Carnation LLC entered a prior consent judgment in 2019, admitting to failing to disclose a blown airbag.
In the current case, the Court found in April that Carnation violated the 2019 consent judgment and the KCPA. The Court ordered Carnation LLC to pay $2,000 per car in restitution, which the dealership’s bonding company later paid. Carnation was also ordered to pay $390,000 in civil penalties, court costs and investigation fees. The Court also revoked Carnation’s license to do business in Kansas and issued a permanent injunction against Carnation from selling any motor vehicles in Kansas.
Decision on Wichita paid parking plan pushed off again
In the latest default judgment, Ajibolade was found to be personally liable with Carnation for the remaining balance of the judgment, $394,197. The Court also revoked Ajibolade’s license to do business and permanently prohibited him from selling cars in Kansas.
The Sedgwick County District Attorney’s Office reminds car buyers to examine a Carfax or similar history of a vehicle before purchasing it. They also recommend performing a general online search of the Vehicle Identification Number (VIN), which can often reveal photos of prior damage to the car.
