New Delhi: Delhi High Court has sought the stand of former CM Arvind Kejriwal and 40 other accused in the excise policy case on a plea by ED challenging a trial court's order. The order directed the agency to furnish "unrelied documents" with scanned copies to all the accused in the case.
ED raised a technical objection, stating that Supreme Court had sttated that only a list of documents had to be given before the trial stage and not complete copies.
A single judge bench of Justice Manoj Kumar Ohri listed the matter for further hearing on Jan 30 next year. The notice was issued by HC in ED's petition as well as its application for a stay in the case. In Nov, the trial court directed ED to supply the chargesheet and the digitised records of the remaining "unrelied documents" (those not used by the prosecution to support their case) to the accused in the case.
The agency, raising an objection, said the trial court gave ED direction at the stage of scrutiny of documents to supply unrelied upon documents to the accused. However, according to the apex court's direction, only a list of unrelied upon documents had to be given at this stage.
