New Delhi: A bail plea can be filed after the rejection of earlier applications if there is a change in the circumstances, a Delhi court stated recently while granting bail to two accused in a 2020 Delhi riots case.
The court of additional sessions judge Pulastya Pramachala said, "A subsequent bail application can be filed after the rejection of earlier applications if there is a change in the fact situation or law, which requires the earlier view to be interfered with or where the earlier finding has become obsolete." The court was hearing the bail pleas of Mohammed Yunus and Imran Ansari, accused in the rioting case pertaining to the assault of a police team that left Delhi Police head constable Ratan Lal dead.

The court observed that Yunus's bail plea was dismissed 10 times previously, while Ansari filed his seventh bail application. Noting the submissions by the accused persons about two other co-accused being granted bail by the high court on Nov 4, the court said, "As far as change in the fact situation is concerned, it is not in dispute that the aforesaid co-accused persons were granted bail by the Hon'ble High Court of Delhi in this case, after the dismissal of the last bail application of this applicant. The role of the applicant and co-accused persons need not be much deliberated upon herein as the same was already discussed in the order on charge, which was passed yesterday itself in this case. I do find that the ground of parity should be accepted as a ground to allow this application."
The court directed the duo to furnish a personal bond of Rs 10,000 and a surety bond of the same amount each. Other bail conditions included the accused persons not trying to influence witnesses, not leaving the country, and informing the court if their addresses changed.
