Restrictions under stage 4 of GRAP to continue in Delhi-NCR even if AQI level falls below 450, says SC

The apex court asked the state government about steps being taken to curb rising pollution level in the national capital. The top court said it will not allow scaling down of preventive measures under stage 4 of GRAP even if AQI goes below 450.

The Supreme Court on Monday (November 18) directed restrictions under stage 4 of GRAP to continue in Delhi-NCR states even if the AQI level falls below 450. The top court has directed all NCR states to immediately constitute teams to implement restrictions under stage 4 of GRAP to check pollution levels. It also asked NCR states to set up a mechanism where complaints can be made for violation of restrictions under stage 4 of GRAP.


The court added it is the Constitutional obligation of all states to ensure citizens live in pollution-free environment. The apex court pulled up the Delhi government over the delay in implementing stage 4 of the Graded Response Action Plan (GRAP) in the national capital despite an alarming rise in the pollution level.

The court said the government will need its permission to scale down preventive measures. "We won't allow scaling down of preventive measures under stage 4 even if AQI goes below 450. Stage 4 will continue till court permits," the bench of Justices Abhay S Oka and Augustine George Masih said.

"The moment the AQI reaches between 300 and 400, stage 4 has to be invoked. How can you take risk in these matters by delaying applicability of stage 4 of GRAP," the bench told the counsel.

The court has asked Delhi-NCR states to a take call on conducting physical classes up to class 12. Currently, the Delhi government has suspended physical classes for students up to class IX and class XI. In-person classes for students of standard X and XII, however, continues to run as usual.

Gurugram, Deputy Commissioner Ajay Kumar has ordered the closure of schools up to 5th standard with effect from November 19 until further orders, an official statement said.

After an analysis of the Air Quality Index (AQI) of the district, pollution levels in some areas were found to be in the "very poor" category, while it touched the "severe" category in some other parts over the past 24 hours

The apex court has pulled up the Commission for Air Quality Management (CAQM) saying, "Some sense of urgency needs to be there." The Bench observed that the CAQM waited for improvement in weather condition instead of implementing different stages of GRAP over alarming rise in pollution level.

On November 17, the Commission for Air Quality Management (CAQM) announced stricter pollution control measures for the Delhi-NCR under GRAP-4, effective from 8 am on Monday, including a ban on truck entry and a temporary halt on construction at public projects.

The apex court is hearing a plea seeking directions to curb air pollution in the national capital and adjoining areas.
