Assembly elections 2024: All you need to know about NOTA

Polling for the 2024 Assembly elections in Maharashtra, as well as the second-phase vote in Jharkhand, is scheduled for Wednesday, November 20. Voting in Maharashtra will be conducted in a single phase for all 288 seats.


On the other hand, the first phase of the election took place on November 13 in 43 of 81 Assembly constituencies in Jharkhand. The remaining 38 seats will go to polls next week.

The result of the assembly election for both states is scheduled to be announced on November 23.

What is NOTA?

NOTA, which stands for None of The Above, is an option that allows voters to express their dissatisfaction with all candidates contesting in a particular constituency in any election. This allows individuals to formally express a vote of rejection, signifying disapproval or lack of trust on the contesting candidates. The NOTA option is available on the panel of all EVMs and ballot papers.

When was NOTA introduced?

The Election Commission of India introduced this said option on ballot paper and electronic voting machines (EVMs) in 2013. Since then, voters have had the option of selecting NOTA if they do not want to vote for any of the candidates running in any of the elections.

It was introduced in September 2013 in response to a Supreme Court order that year directing the Election Commission "to provide necessary provision in ballot papers/EVMs, and another button called "None of the Above" (NOTA) may be provided in EVMs.".

Who designed the NOTA symbol?

The symbol for the NOTA was designed by the National Institute of Design (NID), Ahmedabad.

How NOTA impacts the elections

While the NOTA option is critical for secrecy and democratic expression, its impact on the final total remains insignificant. This vote signifies a neutral stance with no numerical value when it comes to deciding the winning candidate. Though the NOTA votes may not affect the poll outcome, the idea behind the initiative is to boost the moral and ethical standards in the electoral process as higher NOTA votes would be seen as a rejection of candidates. This would prompt the political parties to field candidates acceptable to people.

What is the objective of NOTA?

As per the Elections Commission, the main objective of the NOTA is to enable voters to exercise their rights not to vote for any candidate.

The Supreme Court in its 2013 verdict noted that the ‘right to vote also includes a right not to vote, i.e., the right to reject’.

What happens when NOTA gets the maximum votes?

According to the existing law, there is no legal consequence if NOTA gets the majority of the votes. Reportedly, the candidate with the highest vote following NOTA votes will be declared as the winner in such a situation.
