A hot potato: Security researchers play a vital role in protecting the internet from cyber threats. They locate and disclose vulnerabilities in critical systems to protect users and state institutions. So, it's no small affair when a government entity takes legal action against these watchdogs.

In a strange turn of events following a significant ransomware attack on the city of Columbus, Ohio, a judge has issued a temporary restraining order against cybersecurity researcher David Leroy Ross. The Dispatch notes that Ross allegedly published information regarding a security breach last month that he felt officials were trying to sweep under the rug.

The July 18 attack was attributed to the ransomware group Rhysida. It resulted in the theft of 6.5 terabytes of sensitive data hosted on Columbus city servers. Rhysida attempted to auction the information for $1.7 million in Bitcoin. However, failing to find a buyer, the group released approximately 45 percent of the data on the dark web.

Columbus Mayor Andrew Ginther initially assured the public that the stolen data was either encrypted or corrupted, rendering it unusable. However, under the alias Connor Goodwolf, Ross challenged these claims by presenting evidence to local media that the data was intact and contained "highly sensitive" information. This data included personal details of city employees and residents, sensitive information from domestic violence cases, and the Social Security numbers of police officers and crime victims.

In response to Ross's disclosures, the city of Columbus filed a lawsuit against him, alleging criminal acts, invasion of privacy, negligence, and civil conversion. The lawsuit argues that by downloading and disseminating the data, Ross interacted with criminal elements on the dark web, requiring specialized expertise and tools. The city also contends that his actions made the data more publicly accessible, posing a significant risk to public safety.

"The dark web-posted data is not readily available for public consumption," city attorneys claimed. "[The] defendant is making it so."

A Franklin County judge issued the restraining order this week, prohibiting Ross from accessing, downloading, or disseminating any of the stolen data. The decision was made "ex parte," meaning it was issued without notifying Ross or allowing him to present his case.

Ars Technica notes that City Attorney Zach Klein defended the legal action, stating that the lawsuit was necessary to prevent the dissemination of stolen criminal investigatory records and to protect public safety.

"This is not about freedom of speech or whistleblowing," he said. "This is about the downloading and disclosure of stolen criminal investigatory records."

Unsurprisingly, the restraining order has sparked controversy. Ross accused the city of attempting to scapegoat him for its security failures. He has indicated plans to seek legal recourse, potentially involving the American Civil Liberties Union. Meanwhile, the city faces additional legal challenges, as civil attorneys have filed at least two lawsuits seeking class-action status over the city's failure to protect personal information.

You can't really fine a government though. Doing so is only taking more money away from the citizens who pay taxes to that entity. It doesn't help anyone to fine a city. What might help is removing the responsible public officials from office to ensure accountability.

That maybe the dumbest thing I have ever heard a judge say,a nd that is saying a lot. What tools does the dark web require that the public cant access? ANYONE can get there, if they want to. Its not hard.

This should be grounds to throw out the restraining order immediately. Secret courts should be highly illegal, full stop.

This ignores, of course, that what said judge did violated Brazillian law and is totalitarian in nature, relying on the dictatorial powers of one angry judge to censor an entire country. Censorship is a weed, a highly toxic one, that spreads and consumes all around it until only the eilite may speak. It's bad when China does it, its bad whent he USA does it, and it's bad when Brazil does it.

Because, as we well know, laws are not always fair, or just, or even reasonable.
Ah, the old "no bad tactics only bad targets" lineup. Just because an action benefits Your Side (tm) does not make it good. We have a term for that line of thinking, Wingcuckery, when one undermines themselves just because it affect the Bad Men (tm).

Hate Elon all you want, but censorship is NOT "good" under any stretch of the imagination. Especially when it comes in on the wings of a dictator judge whom breaks his own country rules because people said mean things about him on twitter. Said behavior should NEVER be normalized.

Then take it away from their tax revenue for the following year. Dont let them collect in the fist place, and they will change their behavior.

Sometimes they do good.
What law? The one he doesn't follow? This judge has violated at least 5 constitutional norms, the only reason he hasn't fallen and been arrested is that the people with the power to do this (senators) are dirty and afraid of being investigated for corruption.

He's now frozen bank accounts and assets for Starlink -- an entirely separate corporation and one, like X, that is only partially owned by Musk.

What legal justification has he given for this? None -- he feels he needs none.

That's great but the people who are most likely to use this data for nefarious purposes are precisely the people who are already quite capable of seeing it on the dark web.

I think what the city attorney means is that the public who are going to be mad at the city government might not have known what actually happened if this meddling kid hadn't told them.

But isn't that the whole point of the guy releasing part of the data, to show that the City lied when it said the "stolen data was either encrypted or corrupted, rendering it unusable", that was a lie and anyone willing to look on the dark web knew it, but since most people actually believe their politicians, don't know why, they would have never looked. IOW the City was trying to avoid any lawsuits coming from someone using the data and causing alot of harm.

This isn't about censorship or fascism. Elon just wants to think he can do whatever he wants in whatever country he wants. He broke the law and refused to take responsibility.

When you allow calls for violence, racism, easily identified misinformation and other crap on your platform in the name of "free speech" with zero moderation then you should expect to be banned eventually. No wonder I can only see scams and porn ads on twitter for the better part of 2024.

The violence in UK started with misinformation and calls for racial violence... and what did Elon Musk do? He spammed every day "civil war" and anti-immigration crap, instigating more violence even after it was shown to the whole world that the information was just fake propaganda from far-right extremists. It's just pathetic to call this "free speech".

As for the "free speech" activists here. You are literally defending someone who is arbitrarily deciding things. It's not a secret that anti-fascist accounts were banned since Elon invited Ando Ngo to "report" their accounts directly to him. And let's not talk about the suspensions/bans/shadow bans of LGBT groups/accounts. We all know how much he hates his child...

Didn't he ban Nelson Mandela's grandson when he sent aid into Gaza a few months ago? The only reason I can think of (since none were given) is Elon's previous declaration that Palestinians are the "new generation of murderers".

As for the suspension of other businesses owned by Elon, I find it completely normal. If Elon wants to play the "I'm above the law" game then suspension all of his businesses is only natural.

Eventually this will lead to the EU & UK also fining twitter if he continues to refuse to moderate extreme content.
