Mandatory to remove Tweets: Delhi HC to X Corp in Rajat Sharma defamation case

The Delhi High Court reprimanded social media platform X Corp (Twitter) for challenging a court order to remove posts by Congress leaders accusing journalist Rajat Sharma of using abusive language against Ragini Nayak on live television.

The court, led by Acting Chief Justice Manmohan and Justice Tushar Rao Gedela, expressed concern about X Corp’s behaviour, emphasizing that it should function as a neutral platform and comply with court orders. The Acting Chief Justice highlighted a growing trend of resistance to court orders.

Justice Gedela questioned why X Corp would oppose the order, especially when someone’s reputation is at stake. X Corp’s representative, Senior Advocate Rajshekhar Rao, argued that the platform has no personal stake in the matter and emphasized the need for a structured process.

The case arises from an ex parte order issued on June 14th, directing the removal of social media posts and videos by Indian National Congress and its leaders Ragini Nayak, Jairam Ramesh, and Pawan Khera. The court believed the Congress leaders had exaggerated the incident and misrepresented facts.

Rajat Sharma has filed a defamation suit seeking ₹100 crore in damages.
