A misdemeanor battery charge remains from the night in question, to which the 23-year-old has already pled not guilty.

Attorney Brandan Davies maintains Jackson Mahomes’ innocence, saying in a statement that his client “has done nothing wrong. We had full confidence that the truth of the matter would ultimately be revealed.”

Felony charges against Jackson Mahomes, the obnoxious younger brother of NFL star Patrick, could be dropped as prosecutors claim the alleged victim is no longer cooperating. Officials at the Johnson Country, Kansas District Attorney’s Office filed a motion to dismiss all charges against the wannabe influencer Tuesday.

According to court documents obtained by TMZ, prosecutors representing the restaurant owner who claimed Jackson forcibly kissed her inside her Overland Park business in February 2023 have now apparently said she does not wish to move the trial forward. She wishes “the matter to be dismissed as to anything involving” her, the gossip outlet reported.

Prosecutors still tried to move the case forward without her involvement, citing in case documents that the incident “was captured in its entirety on surveillance footage.” However, the alleged victim reportedly claimed she would say “that she had not been truthful to the police and that the encounter with [Mahomes] was consensual,” according to TMZ.

A judge is expected to make a ruling on the filing during a hearing on Wednesday, dismissing the three felony charges would bring the case down to one misdemeanor battery charge. (Jackson reportedly shoved a waiter at the restaurant on the same as the alleged incident involving the owner.)

“Like I said from the beginning,” Mahomes’ attorney Brandon Davies said in a statement to FOX 4 KC Tuesday, “Jackson has done nothing wrong. We had full confidence that the truth of the matter would ultimately be revealed. The defense will reserve further comment until the remaining count is disposed of.”
