After independence, there was discussion on Uniform Civil Code, Dr. BR Ambedkar, Chairman of the Drafting Committee of the Constitution, had given strong arguments in favor of Uniform Civil Code in the meeting of the Constituent Assembly. Then the Muslim members had lodged a strong protest in the Constituent assembly regarding the adoption of Uniform Civil Code.

Meanwhile at the same time, the country's first prime minister Jawaharlal Nehru was also in favor of Uniform Civil Code after independence. However, Nehru felt that the implementation of the Uniform Civil Code would create insecurity among the Muslims who remained in india due to the violence following partition. He was successful in codifying Hindu law, but his government could not take steps to reform Muslim personal law.

The supreme court and various High Courts of the country have many times emphasized the need to implement a Uniform Civil Code. On april 23, 1985, the Constitution Bench headed by the then CJI YV Chandrachud, in its historic decision, had ordered Shah Bano's husband to pay her Rs 179.20 every month for maintenance. However, later the then rajiv gandhi government overturned the decision of the supreme court by making a law in the Parliament.
