The Shiv Sena case was mentioned in the morning by advocate Amit Anand Tiwari, who represented former Maharashtra chief minister Uddhav Thackeray. A bench headed by Chief Justice of India (CJI) DY Chandrachud observed that the case needs time for final adjudication.
A Constitution bench is slated to commence final hearing of the pleas challenging abrogation of Article 370 from Wednesday.
The petition contended that the poll panel erred in holding that disqualification under the Tenth Schedule and proceedings under the Symbols Order operate in different spheres and that disqualification of MLAs is not based on cessation of membership of a political party.
It also submitted that the poll panel erred in holding that there was a split in the Shiv Sena.
