NOIDA: Residents of Aarcity Regency Park in Greater Noida claimed that the builder has been carrying out illegal construction in the society’s basement by constructing storage spaces for the owners who have shops outside the society.
The residents also said that even though there is no sufficient parking for the 650 flats of the society, the
space is being sold as a storage facility.
According to the residents, some of these storage areas have already been sold to shop owners and not to residents.
“These storage spaces has taken up the basement area, which is illegal as they violate the building by-laws. The builder has not received any sanction in this regard. They are not even able to provide sufficient parking space to residents, but are carrying out this illegal activity,” said Alka Pundir, a resident of the society.
Residents said that they have been complaining to the Greater Noida Authority but no action has been taken by them.
Several other residents claimed that this is the modus operandi of many builders in Noida.
“The builder is building and selling stores in the basement of the society. The construction work is being done without the approved map and the approval of the Greater Noida Authority. About the 6-7 storage construction work is going on,” said Anuj, a resident of the society.
Despite repeated attempts, the builder did not answer TOI queries.
“Builders cannot sell parking space. They can allot parking slots, but our builder is using our parking space to make storage facilities under the nose of the authority ", added Anuj
According to the Real Estate (Regulation and Development) Act, 2016, rules and the apex court “common areas to include open parking areas, thus open parking areas cannot be sold to allottees.”
Meanwhile, project manager Vivek told TOI that they are working according to the building plan. “We are constructing these storage area on vacant spaces in the basement and on the orders of the builder,” said the project manager
Amandeep Duli, the additional chief executive officer of the Greater Noida authority, said, “We will send a team and investigate the matter.”
