Worthington says court ruled EPA overstepped its authority in canister ban

Worthington Industries (NYSE:WOR) said Tuesday the D.C. Circuit Court of Appeals supported the company's position in concluding the U.S. Environmental Protection Agency’s 2021 ban of non-refillable refrigerant cylinders is invalid because the EPA overstepped its authority.
Worthington (WOR) had filed a petition for review - the equivalent of a lawsuit - in December 2021 challenging an EPA ruling that would ban a non-refillable canister made by the company and widely used by the HVAC and refrigeration industries to recharge air conditioners; Worthington has made the canisters for 40 years and is the only U.S. manufacturer of the product.
The EPA had ruled the canisters can contribute to hydrofluorocarbons, a greenhouse gas, leaking into the atmosphere, and said the canisters could not be filled starting in January 2025 or sold starting in January 2027.
Worthington (WOR) argued the EPA based its ban on a European canister that is not used in the U.S. and that the EPA lacked the legal authority to ban the canisters.
The company said it will request the EPA, in keeping with the Court's ruling, publish a direct final rule that restores certainty for Worthington (WOR) and its customers.
