MUMBAI: A sessions court last month granted temporary bail to a 62-year-old ailing man, arrested in a cheating case in 2021, two days after he died. While Suresh Pawar died on May 9, he was granted temporary bail for six months two days later.
While granting Pawar relief, the court referred to JJ Hospital's medical reports on the line of treatment and surgery performed.
"It appears from the medical papers that the applicant (Suresh Pawar) is a severe diabetic and his right leg below the knee had to be amputated due to septic. He is also suffering from lung infection. Therefore, considering his age, severe medical complications and the further need of medical care, his prayer for temporary bail can be considered on purely humanitarian grounds," the court said.
Pawar's lawyer sought his treatment at a private hospital while praying for temporary bail.
The prosecution and complainant opposed the plea for temporary bail. The prosecution argued that he was being provided proper medical treatment and care at JJ.
Pawar's lawyer submitted that he was severely diabetic and suffering from several age-related diseases. It was also submitted that in February, he had sustained an injury to his toe and was admitted to JJ and was later discharged. It was also submitted that subsequently he developed gangrene on his toe and underwent an amputation. The lawyer said on March 23 Bombay high court directed the jail authorities to provide proper medical treatment and the following month his bail plea was withdrawn. The same day, April 19, he was again admitted to JJ.
