Jaipur: The high court on Thursday stayed the disqualification of Chaksu municipality chairman Kamlesh Kumar Bairwa. He was disqualified by the district court on April 20 on a petition by Vinod Kumar Rajoriya who alleged that Bairwa contested the election during the one-year liability period of defect in construction work. The court granted a stay on the lower court’s order, saying that a decision on the appeal would take time to decide.
Following Bairwa’s disqualification by the district court, the state election commission had issued notification for a byelection for the Chaksu municipality chairman post on May 11.
In his appeal, Bairwa’s counsel argued that he contested the election after the executive officer of Chaksu municipality issued a no-dues certificate. Hence, his election to the post of member and later of chairman of the municipality was legal and did not suffer from any irregularity warranting disqualification.
