Biden Abandons a Military Contractor at the Supreme Court

Air-traffic controllers who worked in Afghanistan ask the Justices for immunity.

At the Supreme Court’s private conference this week, the Justices were set to consider whether to hear a petition from a U.S. military contractor that did air-traffic control in war-torn Afghanistan. A 2010 crash led to a state tort lawsuit, and now the question is whether civilians have federal immunity if they enter a battle zone in support of American troops. The Biden Administration’s puzzling answer is no.
