Murder accused wants bail to join pregnant wife, Surat court rejects plea

SURAT: A court here has rejected the plea of a 23-year-old murder accused who wanted bail on the ground that his wife was about to deliver their child. The court observed that at the time of delivery a woman is required to be present with a woman and there is no need for a man to remain present.
The court further noted in the order that accused Prashant Rajput had not returned to jail after one week of bail in June 2022 and had run away. He was later caught by police and sent back to jail.
The court of additional sessions judge M F Khatri rejected the bail following objections raised by public prosecutor Digant Tewar and complainant’s lawyer Ashwin Jogadiya.
Rajput had approached court for 30 days of interim bail so that he could be with his wife who is eight months’ pregnant. The court noted from the papers submitted before it that his wife is getting proper and timely treatment.
“In this situation, at the time of delivery a woman should accompany a woman and there is no need for a man’s presence. The accused wants to come out of jail at any cost and earlier the accused did not return to jail in time (after bail),” the court noted in the order.
“Hence considering the earlier behaviour, the accused was absconding and changed his residence. And it is possible that the accused will run away permanently if released on bail. This will deprive the deceased and complainant of justice,” the court stated.
Rajput is allegedly involved in murder of Sanjay Vaniya who was killed at Dabholi crossroads on July 28, 2021. Rajput got bail for a week to marry in June 2022 but did not return to jail after the bail period was over. Later, the complainant in the case, Dipak Vaniya, had approached senior police officials to request for Rajput’s arrest.
