Man pleads guilty in beating death on North Clinton Ave.
UPDATE (May 5, 2023): A Rochester man on Thursday pleaded guilty for the 2022 beating death of Gerald Wayne Irvin, 65, on North Clinton Avenue in Rochester, according to the Monroe County District Attorney's Office.
Traveon Gates, 20, pleaded guilty to first-degree manslaughter, a felony, in connection with Irvin's killing, and to third-degree criminal sale of a controlled substance, a felony, in connection with a May 2021 incident.
Irwin was attacked while walking on North Clinton Avenue just before 2 a.m. on April 18, 2022. He suffered a severe head injury when he was "knocked to the ground and viciously beaten," police said. Irvin died from his injuries on May 29, 2022.
Police said Gates recorded part of the attack in Irwin on his cell phone.
“The brutal attack that led to the death of Gerald Wayne Irvin is among the most violent assaults I have witnessed,” said Assistant District Attorney Jennifer Hyatt, who prosecuted the case with ADA Matthew Hogestyn. “It was without reason or provocation. Treveon Gates had multiple opportunities to walk away from the victim but continued to beat him even after Mr. Irvin was unresponsive."
Gates will be sentenced to 30 years in state prison and five years post-release supervision. He is scheduled to be sentenced by state Supreme Court Justice Judith Sinclair on July 18.

ORIGINAL STORY (Nov. 7, 2022): A man was charged last week in the beating death of a man who suffered a severe head injury and died in May.
Treveon Gates, 20, was charged Friday with second-degree murder in the death of Gerald Wayne Irvin, 65, of Rochester. Irvin was attacked while walking on North Clinton Avenue just before 2 a.m. on April 18. He suffered a severe head injury when he was "knocked to the ground and viciously beaten," police said. Irvin died from his injuries on May 29.
Gates, who was apprehended on North Clinton Avenue on Friday, is also accused of having more than 100 bags of Fentanyl on him. He was also charged with third-degree criminal possession of a controlled substance.
