Need to conduct preliminary enquiry before filing FIR: Delhi police to Supreme Court

The Delhi Police told the Supreme Court on Wednesday that a preliminary enquiry would be required before registering an FIR over allegations of sexual harassment and exploitation levelled by a few female wrestlers against Wrestling Federation of India chief Brij Bhushan Sharan Singh.

Appearing on behalf of the Delhi Police, solicitor general Tushar Mehta made a mention in this regard on Wednesday before a bench headed by Chief Justice of India (CJI) DY Chandrachud.

The solicitor general said: "Some preliminary enquiry may be needed. If this court orders, then yes FIR can be registered". But he added that there should be some preliminary enquiry.

In response, the CJI said the court does not proceed unless it has some material before it. The issue involves a minor, the CJI said, and asked the solicitor general to furnish the material which the Delhi Police have on Friday.

Appearing on behalf of the wrestlers, senior advocate Kapil Sibal said the petitioners will also place on record an "additional affidavit". The matter will now come up for resumed hearing on Friday.

On Tuesday, the Supreme Court issued notices on a plea filed by the grapplers seeking directions to the Delhi Police to register an FIR against Singh.
