Defendant in University Hill shootout set for trial

Apr. 24—One of the defendants in a shootout on University Hill is set for trial in the fall.

Gabriel Sharma, 19, pleaded not guilty Monday in Boulder District Court to attempted first-degree murder — after deliberation, attempted first-degree murder — extreme indifference and a crime of violence sentence enhancer.

Sharma is now set for trial starting Oct. 23, with a motions hearing on Aug. 9. He agreed to extend the deadline on his speedy trial rights to accommodate the trial date.

He remains in custody on $500,000 bond.

His codefendant in the case, Zakiyy Lucas, has an arraignment hearing on Friday.

According to an arrest affidavit, police were investigating a nuisance call on University Hill on Oct. 2 when they heard a witness had called 911 about a large brawl that possibly involved firearms nearby.

A video of the fight showed one man on the ground wearing a dark shirt and khaki pants being punched and kicked by two other men, including Sharma.

Video footage later showed Sharma yelling at a man later identified as Lucas. The two then begin to exchange punches when Lucas went into a yellow vehicle parked nearby and returned with a rifle, the affidavit said.

A responding Boulder police officer, Eric Stephens, saw Lucas fire his weapon, which prompted Stephens to begin firing his weapon.

According to body camera video, Lucas then dropped his weapon and began to run before Stephens told him to stop. While the officers were putting Lucas into custody, Sharma is believed to have fired four shots in their direction, after which Lucas tells police he had been shot in the arm.

Doctors said a bullet passed through Lucas' forearm, but they could not determine the type of bullet or direction of the shot. Stephens, who was cleared of wrongdoing in the shooting, said he fired four shots and believes that he was the one who hit Lucas.

Sharma was identified as the other shooter through witness testimony. He was later located and arrested.
