Jaipur: The Supreme Court has issued a notice to the state home secretary, then ACB DSP Sanjeev Kumar and minister Shanti Dhariwal on a petition challenging the high court’s order to end the infamous single lease case against Dhariwal.
The Supreme Court gave this order on a SLP by a private person on Monday. In the SLP, the Rajasthan High Court’s order on November 15, 2022 was challenged in which the single bench of the HC had cancelled the action initiated by the ACB on the orders of ACB Court-4 in the case. The HC had also cancelled action-to-be-taken in the protest petition filed in the ACB court on January 3, 2022 against Dhariwal.
Sandesh Khandelwal, counsel for the petitioner, said in the SLP that the FIR of the case registered against corruption cannot be quashed only on the basis of the complainant’s agreement. It is the case of the state government which is against corruption.
The HC has also ignored the directions of the Supreme Court in its decision, it was argued. The Supreme Court had directed the lower court to decide the closure report and protest petition of the state government.
The lower court had cancelled the closure report of police and directed further investigation. In the meantime, the applicant filed a petition in the HC and requested to cancel the ongoing investigation and the action in the lower court.
Dhariwal said there has been a settlement between the complainant and the minister in the matter and legal proceedings in the lower court and ACB be quashed which the high court did.
