Police tase 80-year-old man who drove 38 mph in 35 mph zone: lawsuit
An 80-year-old man is suing police in Kansas, who zapped him with a Taser after clocking him driving 38 mph in a 35 mph zone.
John J. Sigg alleged Monday he was driving through Iola, Kan., east of Wichita when — unbeknownst to him— officers from multiple departments began their pursuit.
When Sigg arrived at a car lot run by his family, he found himself surrounded by police officers with drawn guns.
“Sigg looked at them quizzically and raised his hands,” the suit claims.
According to the octogenarian motorist, an Allen County deputy tased the elderly man while ordering him to get on the ground. The plaintiff said he posed no threat to the officers and was not a flight risk.
After being shocked by the deputy, Sigg mumbled that he wasn’t feel right and needed to go to an emergency room. His lawsuit against the Allen County Sherriff and that deputy, who’s no longer on the police force, asks for $250,000 in damages and that same amount in punitive penalties.
Roughly 500 people have died after being tased by police between 2010 and 2021, according to researchers at Fatal Encounters.
A 76-year-old Colorado man sued the Idaho Springs Police Department in 2022, claiming he suffered a stroke after being tased by police responding to a complaint he allegedly struck a female neighbor. According to that plaintiff’s attorney, his client can no longer live on his own, but he’s $7 million richer because of the civil suit.
