BENGALURU: The Karnataka high court on Thursday extended the stay order regarding the ongoing probe against Karnataka Pradesh Congress Committee( KPCC) president DK Shivakumar till April 13 vis-a-vis the FIR registered in connection with a disproportionate assets case.
The court also adjourned the hearing on a separate petition filed by him related to the a 2019 order passed by the state government issuing consent to the CBI to proceed in the matter.
There is already an interim protection not to take any coercive measures against him.
During the hearing, the counsel for DK Shivakumar claimed that order passed by the high court on the petition filed by Shashi Kumar Shivanna, one of his relative, vis-a-vis consent order would not have any bearing as he was a HAL employee.
In his petition challenging the FIR, Shivakumar had claimed that as per the earlier order of the high court, the CBI could not have initiated coercive measures against him and added that there is no sanction obtained under Section 17 A of the PC Act to prosecute him.
The CBI had registered the FIR on October 3, 2020 under the provisions of Prevention of Corruption Act, following a consent accorded by the state government to investigate the matter .
The CBI claims that during the check period between April 1, 2013 and April 30, 2018, DK Shivakumar and his family members were in possession of disproportionate assets worth around Rs 74.8 crore which he failed to explain with proper documents.
