Kanpur: Special judge, POCSO Act court, Surendra Pal Singh convicted one Ram Kumar Yadav for physically exploiting a minor girl under IPC sections and POCSO Act on Thursday and punished him with a sentence of 10 years rigorous imprisonment along with a fine of Rs 25,000.
The presiding judge in his order also observed that a sum of Rs 20,000 from the fine amount be given to the victim under the provisions of POCSO Act and if the accused failed to pay the fine, he will have to serve another six months of jail term.
According to special public prosecutor Bhawna Gupta, the report of the incident was lodged by the father of the victim.
In his report, he had alleged that he had gone to Shivala temple on August 7, 2018 evening leaving behind his five-year-old daughter in the house of a neighbour Ram Kumar Yadav. When he returned around 10 p.m., his daughter came out weeping and said that she was feeling pain in the lower part of abdomen. When her mother examined her, she found blood stains on her pyjamas. She said that the man had put his hand on her genitals.
When police visited the spot, Ram Kumar Yadav managed to escape but was nabbed later. The medical examination verified that sexual harassment had taken place with the victim once and that too was by one man. The presiding judge after going through the case file and evidence on record held Ram Kumar Yadav guilty and punished him accordingly.
In another judgment, additional sessions judge (court number 25) Pramod Kumar (IV) convicted one Ram Kishora Nishad for abetment of suicide and punished him with five years simple imprisonment along with a fine to the tune of Rs 10,000. The presiding judge also observed that if the accused failed to pay the fine then he had to suffer another two months jail term. The term he had suffered in jail during the trial would be adjusted, the judge added.
According to additional district government counsel Bhaskar Mishra, complainant Ram Kishan Nishad had lodged an FIR at Maharajpur police station that he had settled his daughter’s marriage with one Raj Kishore, a resident of Purwameer in Maharajpur police station area. On December 12, 2008, ‘tilak’ ceremony was observed. He reached along with others and goods at Raj Kishore’s house. Since the goods and gifts brought by him were not up to the satisfaction of Raj Kishore, the marriage was cancelled and Raj Kishore's family returned all gifts. The relationship ended with this act. On January 2, 2019, Raj Kishore intercepted his daughter and abused her. Raj Kishore threatened that he would not allow her to marry and would create hurdles. His daughter was disappointed with the incident and committed suicide by hanging herself.
The presiding judge in his order stated that accused was held guilty for abetment of suicide hence he was liable to be punished. In another judgement, presiding judge Pramod Kumar convicted one Sonu for lurking house trespass, theft and recovery of stolen goods and punished him with six years simple sentence and imposed a fine of Rs 12,000.
According to prosecution, the police had arrested two persons named as Rakesh and Sonu, both residents of village Kunda in district Bahraich. A police party led by station officer Satyendra Singh Rathore was returning from a raid around 1.10 a.m. on December 11, 2010. In Sanjay Market, the police party witnessed that the shutter of a shop was half open and a rickshaw trolley loaded with cartons was parked there.
On doubt, the police party reached the spot and called the person inside. The persons inside opened fire and tried to run away but the police caught them. One country-made pistol with one live cartridge and a knife was recovered from their possession. Two inverters were loaded on the rickshaw trolley. Shop owner Syed Ali Hussain identified that the inverters were of his shop.
The police registered two cases against the accused, one was of attempt to murder and second was of trespass, theft and recovery of stolen goods.
Meanwhile, special Judge Pocso Act/additional sessions judge (court No. 25) Parvez Ahmad in the judgement convicted one Nitin Kumar alias Nikka for outraging the modesty of a minor girl with four years rigorous imprisonment and slapped a fine of Rs 10,000. The presiding judge also observed in his order to give a sum of Rs 10,000 to the victim for her physical and mental agony as damages.
