IND vs AUS: Delhi Family Court rebuffs Australian courts' comment in Shikhar Dhawan-Ayesha Mukherjee's divorce case

A family court in Delhi has rebuffed Australian Court’s comment on Indian courts and judiciary in Indian cricketer Shikhar Dhawan and Ayesha Mukherjee’s divorce case. Family Court Judge Harish Kumar said on Thursday that the foreign courts should discard their attitude that Indian courts are still in the pre-independence era.

This comment has come after Federal Circuit and Family Court in Australia on February 2, had asked the Indian opener to submit to its jurisdiction and withdraw the proceedings initiated by him against his wife in the Family Court in Delhi’s Patiala House Court.

Judge Harish Kumar said that the Indian courts are now conducting proceedings even through video conference and has made tremendous improvement in application of technology in all walks of life. And that’s why no one should remain under misconception that Indian Courts are still in pre-independence era.  

For the unversed, cricketer’s ex-wife Ayesha Mukerji is a Melbourne based kickboxer and had moved the Australian court for maintenance. On the other hand, Shikhar Dhawan had moved to the family court in Delhi for divorce and custody of child case. Moreover, in the last hearing at Delhi court, the bench had asked the estranged wife not to spread rumours about the cricketer.

The Australian court, in its order had stated that they had no idea how courts in India function and adjudicate parenting disputes or custody matters. And said that since both Shikhar and Ayesha understand English, they can continue to pursue their litigation in Australia instead of India. The Australian court had also asked Dhawan to pursue the child custody and divorce petition before the Australian Court as well. 

Taking objection to the observations made by the Australian court, the family court at Delhi said that this reflects inappropriate understanding of the law of India qua parenting and conditions prevalent in India. Judge Kumar even stated that Indian courts pass parenting orders keeping in mind the best interest of the child and not language.  

He further wrote in a 9 page order that almost all courts in India conducts its proceedings both in English as well Indian language prevalent. Hence, respondent herein would not have any difficulty in understanding and participating in the proceedings in India.

Judge Kumar also said that since both, the cricketer and his wife are Hindu by religion and even their son Zoravar is a Hindu, the couple must pursue their litigation in Delhi.

Mathura residents confront policemen over beating up of two men, video viral | Watch

After the video of the incident went viral on social media, the Mathura Police took cognizance of the video and informed that the police have launched an inquiry into the matter and will take necessary actions in the matter.

A video has come to light from Uttar Pradesh’s Mathura where 2 police personnel were seen beating up 2 men in a local area. As per the reports, the incident is reported to come under the jurisdiction of the Vrindavan police station area.

In the video, a policeman can be seen talking to a man in black and then dragging him away from the crowd. Upon seeing the man getting beaten up by the policemen, his friend can be seen jumping in to question the police action. The policemen, unfazed by the law and order protocol, can be seen beating both men for questioning them.

The video also shows one man also dropping to the ground after the police brutally slapped the two men. On seeing the policemen’s actions, the residents in the area couldn’t contain themselves and rushed in to question the police. The victims can also be seen getting up and lashing out at the police as they go on to grab a policeman by his color.

Another incident

Another incident came to light from Uttar Pradesh Kanpur where a man was seen brutally beating up a woman over some trivial spat between the two. As per reports, the incident ensued under the jurisdiction of Shivrajpur police station and the woman has also filed a complaint in the matter.

In the video, a man wearing a red vest was seen grabbing the lady in a very inappropriate manner and pushing her to the ground. As the clip moves further, it shows him punching the victim, and kicking her.

Accident: Truck, bus collide in Haryana's Ambala, 7 killed, 4 injured

Seven people were killed and about four others were injured in a collision between a truck and a bus in Haryana’s Ambala district on Friday. Police gave this information and told that this incident happened on the Panchkula-Yamunanagar National Highway.

According to the police, the incident took place on Friday under Shahzadpur police station area. The injured persons were taken to the nearest hospital, where their treatment is still going on.

Bir Bahan, SHO of Shahzadpur police station told ANI that a loaded trailer truck rammed into the bus moving ahead. Prima facie it appears that the truck driver dozed off and hit the bus. He said the accident was so severe that the trailer truck overturned in the opposite direction.

The drivers of both the vehicles are out of danger. He said that further investigation of the accident is being done. Most of the people aboard the bus were migrant laborers doing construction work. The casualties were pulled out of the bus with the help of passers-by.

Indian Railways on March 4 has cancelled over 250 trains owing to maintenance-related work on the railway platforms, track and overbridges. As per the IRCTC reports, 90 trains have also been partially cancelled.

The impacted areas where trains have been cancelled include Delhi, Lucknow, Bokaro Steel City, Buxar, Kanpur, Asansol, Nagpur, Pune, Pathankot, Madurai, Rameswaram, and several others.

Every week the Indian Railways cancel hundreds of trains owing to maintenance and operational work on the tracks, platforms and more.

For refund, passengers who booked their tickets from the IRCTC website will be refunded for the same into their source account. However, passengers who booked their tickets from the reservation counter would need to visit the booking counter to process the refund.
