Prayagraj: The chief judicial magistrate (CJM), Prayagraj on Wednesday rejected the applications moved by mafia dons Aitq Ahmed and his brother Ashraf, wherein they had requested the court to direct that they be heard first before any B warrant is issued against them in connection with any case.
B warrant is a production warrant. In case, any person is already lodged in jail and his presence is necessary in any subsequent case, then the investigation officer concerned will move an application before the court for issuance of B warrant against the person concerned. The court may make an order requiring the officer in charge of the prison to produce such person before the court for answering to the charge or for the purpose of such proceedings or as the case may be, for giving evidence.
Former MP Atiq and his brother Ashraf, a former MLA, have been named as accused in the Umesh Pal murder case. Umesh Pal, who was a witness in BSP MLA Raju Pal murder case, was killed along with his security guard on February 24 in Prayagraj. Both Atiq and Ashraf are accused in the Raju Pal murder case also.
According to district government counsel (criminal), Gulab Chandra Agrahri, two separate applications were moved by Atiq and his younger brother Ashraf before the CJM on Wednesday. In the application of Atiq, it was stated that he is at present lodged in Sabarmati Jail while Ashraf in his application stated that he is lodged in Deoria Jail. However, both had requested in their respective applications that they be heard first before any B warrant is issued against them in any of the cases.
