Kanpur: Special judge POCSO Act/additional sessions judge (court no: 23), Kanpur Nagar convicted four brothers for enticing, kidnapping and physically exploiting a minor girl on Tuesday and punished them with 20 years rigorous imprisonment along with a fine of Rs 11,000 each.
The sentenced persons were identified as Anupam alias Golu, Adesh alias Bhole, Abhishek and Shubham, all residents of Barua Bazar, Shahabad, police station Shahabad, Hardoi. The presiding judge also observed in his order that if the accused had served any term in jail, that period would be adjusted in the sentence. Copy of this order be sent to the district magistrate Kanpur to provide a sum of Rs 44,000 as damages to the victim for her mental agony and physical pain.
The judicial officer acquitted co-accused Anant Ram Trivedi and his wife Kusma Devi for want of evidence. The prosecution had failed to prove its case against them.
According to additional district government counsel, Sushil Kumar Verma, complainant Yogendra Kumar had lodged an FIR at Kalyanpur police station on July 24, 2014 and alleged that Anupam alias Golu, Adesh alias Bhole, Abhishek and Shubham, all sons of his relative Anant Ram Trivedi had visited his house on June 2, 2014, around 9 a.m. and said they would return back in the evening.
In the evening, the complainant returned back and found that his younger daughter was missing and on inquiry, his wife informed him that Anupam alias Golu, Adesh alias Bhole, Abhishek and Shubham had enticed and kidnapped her in the evening and left for Shahabad. He immediately rushed to Shahabad and met Anant Ram and informed him of the act of his sons.
Anant Ram and his sons replied that his daughter was in their custody and she was safe but they would not hand her over to him. When he insisted, they not only abused but also threatened him for life. The victim in her statement had stated that the accused, who were her brothers in relation, asked her to join them as they were going to a temple.
In the midway, they forcefully kidnapped her and took her to Shahabad and there they not only tortured her, but also physically exploited her repeatedly. To shut her mouth, they often injected her with some medicines. She was later recovered by the police.
