SP MLA Irfan Solanki produced in court, next hearing on March 4
Kanpur: Samajwadi Party MLA Irfan Solanki and others who have to face criminal trials were produced by the police in the MP/MLA court on Friday.
The MLA, brought by the police from Maharajganj district jail, was first produced in the MP/MLA sessions court in the arson case registered in Jajmau police station. The case has been fixed for framing of charges against him and others. Since judge Satyendra Nath Tripathi was on leave, the accused were produced before the link court (ADJ XVII) Kanpur Nagar who has fixed March 4 as the next date for hearing in the MP/MLA sessions court.
The additional district government counsel said that a few days ago the SP legislator’s brother Rizwan Solanki had moved his bail application before the Allahabad high court but the high court rejected his bail application and directed this court to conclude the trial within six months. The court would now follow the high court’s direction and conclude the trial in the given time. In this case, MLA Irfan Solanki, his brother Rizwan Solanki and others had allegedly set Nazir Fatima’s hut on fire on November 7, 2022 with an intention to grab her plot. Fatima had lodged a report against the MLA and others alleging that they had burnt her hut to grab her plot.
Thereafter the police produced him in the MP/MLA court which is also a court of additional chief metropolitan magistrate (third) regarding a case of forged Aadhar card. The case was also fixed for framing of charges but co-accused Ammar Elahi preferred an application in which he prayed that since the prosecution did not have any evidence against him, therefore, he should be discharged, said public prosecutor Richa Gupta. Special public prosecutor Ambrish Tandon, who is assisting public prosecutor Richa Gupta, said that the prosecution had sought time to file its objection over Elahi’s discharge application after which judge Alok Yadav granted time to the prosecution to file its objections and fixed March 4 as the next date of hearing.
The SP MLA had travelled by air from Delhi to Mumbai on a fake Aadhar card which was fabricated. His driver Elahi was with him during the period he had been absconding, said Richa Gupta.
Elahi stated in his application that the police had made two independent witnesses and 24 formal witnesses in the case against him. One of the witnesses Abdul Kaleem in his statement had told the investigation officer that as he was not present at the time of incident, therefore, there was no proof against him.
