MUMBAI: The Bombay high court has ordered the issuance of a bailable warrant of Rs 5,000 against a Pune police officer who, despite a two-week adjournment granted to enable his response, did not respond to repeated intimations or appear in court as the investigating officer (IO) of the case where an accused was seeking pre-arrest bail. "The bailable warrant shall be sent to the office of the commissioner, Pune, for execution," said Justice N R Borkar, who passed the order on December 19.
The high court was hearing the pre-arrest bail application filed by Poonam Bhoi, a Pune woman accused of kidnapping for ransom another woman and criminally intimidating her over a money dispute. The alleged victim said she was kidnapped on a two-wheeler and had jumped off the back seat.
Bhoi's lawyer, Shailesh Kharat, argued that the case was cooked up. At the earlier hearing he had submitted that if the informant allegedly jumped off a moving vehicle, she would have sustained some injuries and had sought medical papers and case papers from the police.
At the previous hearing on December 5, the additional public prosecutor P H Gaikwad-Patil had sought time when the matter was before Justice N R Borkar, to get instructions from the IO.
The court had adjourned the matter to December 19 at his request.
