Why the hurry, Telangana HC poser to state on regularisation

HYDERABAD: The Telangana high court on Thursday asked the state why it was in a hurry to regularise illegal structures while declining to intervene as a plea against it was pending in the Supreme Court and directed the state to approach the SC instead.
A bench of Chief Justice Ujjal Bhuyan and Justice CV Bhaskar Reddy was hearing a request from advocate general (AG) BS Prasad to modify HC's 2016 order restraining municipal authorities from taking final decision on regularising illegal structures under the state's building regularisation scheme (BRS).
"We will not allow illegal structures like those on government land, the ones that came up in the middle of lakes or in GO 111 areas," the AG said while pointing out that the issue has been in limbo for the six years.
Sivaraju Srinivas, the counsel for Forum for Good Governance, which had petitioned against BRS, said that this scheme only encourages wrongdoers.
He pointed out that HC had earlier closed all related pleas before it because the SC, which was seized of the matter, was collecting data from all states on the subject.
However, AG Prasad clarified the issues pending before SC related to illegal layouts and their regularisation.
"That has got nothing to do with building regularisations where we are planning to help huge numbers of small, marginal and middle class homeowners," he added, requesting HC to make a distinction between the two and allow the state to go ahead. "This will not go against any future decision of the SC because the issues related to BRS are not before it," he said. But the bench declined to intervene.
"We cannot tread this path at your instance. Why is the state showing so much enthusiasm to regularise illegal structures? , the bench said before asking the state seek clarification from SC.
