Jaipur: The Supreme Court on Thursday disposed of a Special Leave Petition (SLP) by the
Bar Council of India (BCI) challenging the Rajasthan High Court’s order to hold elections on December 16.
BCI challenged the single bench order of the high court on October 11 which lifted the stay on bar elections passed by BCI on October 3 this year and the division bench order on December 6 upholding the single bench order on appeal.
The Bar Council's stay on elections followed a petition by lawyer Sumer Singh Ola approaching the BCI seeking to ensure compliance with the guidelines issued by the Supreme Court the principle of “one bar, one vote.”
He alleged that in the voters’ list, there were duplications, and lawyers of various district associations also cast votes in the high court bar association elections which is a violation of the supreme court order of 'one bar one vote'.
The Bar Council of India took cognisance of the matter and stayed the election process throughout the state in all the Bar associations.
Prahlad Sharma, former general secretary of the high court bar association challenged the stay order of BCI in the high court, and the court ordered to conduct elections following the supreme court order which the BCI challenged through an SLP. Abhinav Sharma appeared for the respondent.
