Realtor sells plots in unregistered project, fined ₹2.5cr
Gurgaon: Haryana Real Estate Regulatory Authority (H-Rera) has imposed a penalty of Rs 2.5 crore on a city-based developer for selling 219 plots without registration of the project.
In its order, dated December 9, the Gurgaon bench of H-Rera described the act of the developer, Brahma City Private Limited, as “violation of the provisions of Real Estate (regulation and development) Act of 2016”.
“For violating the provisions of the Rera Act, the authority has decided to impose a penalty of Rs 2.50 crore on the promoter for not applying for registration of its ongoing project within time allowed and allowing sale of 219 plots in violation of the provisions,” the bench said in its order.
The regulator also directed the developer to deposit the penalty within one month. “The promoter is directed to deposit the penalty within one month from the date of issuance of this notice. In case the promoter fails to deposit the penalty as imposed by the authority, it will be recovered as arrears of land revenue and further proceedings will be initiated against the promoter under Section 63 of the Rera Act, 2016.”
As per the order, Brahma City Private Limited is developing a project of plotted residential township in sectors 61-65. “On consideration of the circumstances, the evidence and other records and submissions made by the promoter during the course of hearings, the authority is satisfied that the promoter has violated Section 3 (1) of the Rera Act, 2016,” the bench said.
