Varanasi: The court of district judge on Monday fixed December 7 as the next date for hearing the application of four women plaintiffs in suit no. 18/2022 Rakhi Singh vs state of UP and others, seeking to transfer seven cases related to Gyanvapi mosque from different courts to the court of district judge.
Vishnu Shankar Jain, advocate of plaintiffs 2 to 5 (Laxmi Devi, Sita Sahu, Manju Vyas and Rekha Pathak) in case no. 18/2022, in which they are seeking regular worship of Shringar Gauri and other deities in Gyanvapi mosque compound, said: “We had moved applications to transfer seven cases including six pending in the court of civil judge (senior division) and one in the fast-track court of the civil judge (senior division) to the court of district judge. The district judge has fixed the date of December 7 for hearing on these applications.”
Jain said that the civil suit no. 925/2022 filed by the Shsankaracharya Swami Avimukteshwaranand Saraswati and Ramsajeevan, civil suit no. 245/2022 filed by Satyam Tripathi, Ashish Kumar Shukla of Lucknow and Pawan Kumar Pathak of Varanasi, civil suit no 350/2021 filed by Goddess Maa Shringar Gauri through next friend and devotee Ranjana Agnihotri Lucknow and Asthan Lord Adi Visheshwar through next Jitender Singh Vishen, civil suit no. 358/ 2021 filed by Maa Ganga through next friend Suresh Chavhanke Ahmednagar Maharashtra, Suresh Chavhanke, Umakant Gupta, Anand Sahu, Maneesh Nigam and Rupesh Mishra, civil suit no. 839/2021 filed by Lord Shri Aadi Visheshwar Jyotirlinga through next friend Mahant Shiv Prasad Pandey, Mahant Shiv Prasad Pandey, Sube Singh Yadav, Santosh Kumar Singh and civil suit no. 840/2021 filed by Shri Nandiji Maharaj seated within the precincts of Shri Aadi Visheshwar Mahadev temple through next friend Sitendra Choudhary, Jaihind Choudhary, Akhilesh Kumar Dubey, Vinod Yadav and Ravi Shankar Dwivedi are pending in the court of civil judge (senior division).
Civil suit no. 712/2022 filed by Bhagwan Aadi Vishweshwar Viraajman through next friend Kiran Singh and others is pending in the court of civil judge (senior division) FTC, said Jain adding, these applications have been filed seeking to transfer the cases of similar nature to the court of district Judge.
“It would be in public interest if the suits of similar nature raising identical issues of facts and law are tried together by the same court to prevent the multifariousness of proceedings and, contradictions in judgments/orders on crucial issues and to maintain the appellate/revisional forum equally for all. In case the suits are tried together, the public time, money and unavoidable difficulties of legal nature may not arise,” said Jain while mentioning the prayer of the plaintiffs made in their applications.
