THANE: The sessions court has for the second time rejected the bail application of an accused who killed a 20-year-old boy for robbing his four tola gold chain in Sept 2020 at Waghbil area.
Additional sessions judge PS Vithalani rejected the bail plea of accused Krushna Ghodke.
It was on 3 sept 2020, the deceased AKshay Daki went to his maternal uncle to attend rituals but did not return back. The parents who were worried carried out a frantic search but in vain hence they registered a missing complaint with the Kasarwadavali police.
During the search, the police found his scooter parked near a tree in the nearby vicinity namely Pankhanda. They inquired about the deceased but in vain. Later during the probe it was found that the accused in connivance with other two accused hatched the conspiracy and meticulously planned the murder, took th deceased to a secluded spot and murdered him with a nylon rope.
Later, they hired an auto rickshaw and told the driver that it was just a corpse of a dog in a gunny bag and flung it into a creek during the wee hours. In the meantime, they took out his 40 grams chain for which they murdered him.
The defence counsel prayed for bail but the prosecutor as well as the investigation officer opposed it.
The judge while rejecting the bail application noted, “..while considering the bail application the Court has to strike a balance between individual liberty right of accused and the social interest of community at large.”
The judge further noted in the order, “..It is correct that yet trial has not commenced. However, prosecutor assured that after framing of charge, prosecution would conclude the trial of the case expeditiously. In that view of the matter, only for reason that trial of the case would take some time, benefit of bail cannot be granted to the accused."
