Court grants stay against notice of demolition
Mysuru: A city court has granted a stay against the demolition of a part of building which was allegedly constructed in violation of the building bylaws. This was a bone of contention in the murder case of retired Intelligence Bureau officer RN Kulkarni.
Mysuru City Corporation commissioner G Lakshmikantha Reddy confirmed to TOI that the property owner, Madappa, has got a stay against the notice of demolition of part of the building in TK Layout. “As per the procedure, we issued the first notice of demolition on November 2 and set a deadline of 10 days. Secondly, a final notice was served on November 14 with a 24 hour deadline. The property owner showed a court stay against demolition when the zonal officers went for demolition on Tuesday,” the commissioner said.
Meanwhile, advocate Narendra Gowda, representing Kulkarni in the case, expressed surprise over the development and said they would plead before the court in this regard. The advocate claimed the civic authorities had failed to file a caveat petition on notice of demolition, giving the opposite party an opportunity to obtain a stay. Narendra also claimed the local civic officers didn’t provide them with copies of the recent notices served on the opposite party, which would have kept them in the loop of all developments in the case.
