EWS Reservation News Live: Five judge bench of Supreme Court upholds 10% quota for poor

EWS Reservation News Live Update: Five-judge Constitution bench by a majority of 3:2 upholds the validity of Constitution’s 103rd Amendment Act which provides 10% EWS reservation in educational institutions and government jobs. Justice S Ravindra Bhat and CJI UU Lalit passed a dissenting judgement with the majority verdict. SC said that the reservation structured singularly on economic criteria does not violate the basic structure of the Constitution. It has also held that breach of 50% ceiling limit by EWS reservation does not violate basic structure.
    • Justice Trivedi said that at the end of 75 years of independence, we need to revisit the system of reservation in the larger interests of the society.
    • Representation of SC/ST in Parliament and legislative assemblies was to expire after the time limit. The reservation for Anglo Indians in Parliament has come to end. Likewise there should be time limit.
    • The 10 per cent reservation in all colleges and government jobs was introduced for the poor sections in 2019, just before the general elections.
    • The petitioners had questioned several aspects of the EWS quota, including how it could cross the 50 per cent national cap on reservation set by the Supreme Court in 1992 and whether it changed the "basic structure" of the Constitution.
    • The basic structure of the Constitution, which includes provisions like rule of law and separation of powers, was decided as off-limits to Parliament by the Supreme Court in 1973.
