Pocso court in Surajpur orders FIR for fake rape complaint

NOIDA: A special Pocso court in Surajpur has ordered registration of an FIR against a man for filing a fake complaint that his sister — a minor — had been raped by a neighbour in Noida’s Sector 24 in August. Investigation had found that the woman, who was 18, had married the neighbour and her family was allegedly unhappy about the inter-caste relationship.
In the complaint filed on August 22, the woman’s brother had alleged that he got to know that his 15-year-old sister had been raped by the neighbour as she was 2-3 months’ pregnant. Later that month, cops arrested the accused, who refused the charges against him.
The woman, however, told investigators that she was 18 years old, and had voluntarily married the accused – a 25-year-old man -- without informing her family.
“I had married voluntarily without telling my family members. We both lived together as husband and wife for 2-3 months. My family members were not happy with this marriage. My brother then got an FIR registered at the police station in Sector 24,” she said.
Special public prosecutor Neetu Bishnoi said the family did not support the inter-caste marriage.
Dr Anil Kumar Singh, special judge, Pocso Act (First), on Saturday acquitted the accused on charges under IPC sections 376 (rape), 506 (criminal intimidation) and sections 5/6 of the Pocso Act.
The court said, “A case be registered against the complainant/brother of the victim under Section 344 (giving false evidence) of Code of Criminal Procedure.”
Under Section 344 of the CrPC, an individual can be sentenced to imprisonment for a term of up to three months, or fined.
