Yavatmal: A man accused by police of stealing coal has been fined Rs1 lakh by the Nagpur bench of Bombay high court for filing petitions with ulterior motives, to bring pressure on police officials acting against him.
Irshad Khan Iqbal Khan, a resident of Sai Nagar of Wani, is a coal trader. He was caught by the Shirpur police while stealing coal. Head constable Haribhau Surpam had filed an FIR against Irshad Khan in 2021, and the Shirpur police had registered a criminal offence under sections 379 and 34 IPC against him.
Irshad Khan approached the Wani court to cancel the FIR. Meanwhile, he filed a writ petition demanding Rs10 lakh each from complainant Surpam and the police station officer as compensation for the police registering false FIR against him. This was done even as his case was pending before the Wani court. He alleged that the police have registered the criminal case against him on personal enmity.
The matter was heard by the bench comprising justices Rohit Dev and Anil Pansare. Shirpur PSO Gajanan Karewad filed the affidavit before the court on behalf of the state. The court turned down Irshad’s petition and observed that he has preferred the criminal writ petition with an ulterior motive of bringing pressure upon government servants on duty. The court ordered petitioner Irshad Khan to pay Rs1 lakh to the Police Welfare Fund by challan within 15 days from the date of the judgment.
