CPM organ comes out against Khan
Thiruvananthapuram: CPM’s mouthpiece Deshabhimani came out against governor AM Khan after he wrote a tweet threatening to sack ministers if they lowered the dignity of his office.
Legal experts and political observers made it clear that the exercise of excess power by the governor has no constitutional validity. The governor, who is the administrative head of state, is supposed to function as per the help and advice of the state cabinet headed by the CM. Article 163 (1) declares the same beyond doubts.
“The governor is free to exercise his will only when there is no elected government in office. As per article 164 (1) advice of the CM is the basis of ministers’ appointment. Hence, the pleasure of the governor only means the advice of the CM. Governor needs to develop loss of pleasure regarding the continuance of a minister in the post only when the CM conveys his loss of trust in that person. Article 164 (2) clearly states that the cabinet is responsible to the Assembly. Various SC orders have confirmed this,” stated its editorial.
Under BJP, governors are helping to subvert statements. Wherever such attempts prove impossible, governors try to create an administrative crisis, it said, adding that such fallacies of governors were the reasons that prompted many states to remove governors as varsity chancellors. The editorial reiterated politburo’s demand that the President should intervene and correct the governor’s wrongdoings.
