Gurugram: One leg crushed in crash, minor gets Rs 5 lakh compensation

GURUGRAM: A court in Gurugram has awarded a compensation of nearly Rs 6 lakh to a minor girl, who suffered partial disability after being run over by a speeding vehicle in 2020.
Paridhi Chauhan, a resident of Om Nagar Dhani in Budhera village, and her two siblings were on their way to tuition classes on January 10, 2020, when the vehicle hit him, and one of her legs was crushed under its wheels.
The minor, then six, who remained under treatment for months, had filed a petition, claiming a compensation of Rs 30 lakh. A case was also registered under IPC sections 279 (rash and negligent driving) and 337 (endangering life) at Rajendra Park police station.
"Paridhi Chauhan was six years old at the time of the accident and was a student of primary class. The accident occurred due to the negligence of the vehicle driver,” said Surender Kumar, the counsel for the minor.
Atma Ram, her father who was an eyewitness to the accident, had noted down the registration number of the vehicle that helped the police nab the driver. “The accident occurred due to rash and negligent driving,” he told the court.
In its order, dated October 10, the motor accident claims tribunal of Gurugram, awarded a compensation of Rs 5.82 lakh to the minor, including Rs 2.57 lakh for medical expenses, Rs 3 lakh for disability, and Rs 10,000 for pain and suffering. “In view of oral and documentary evidence on record, it was proved that the accident in question took place because of rash and negligent driving,” judge Jasbir Singh observed in his order.
The compensation will have to be paid by the vehicle owner and the insurance company from where the accused purchased the mandatory third-party insurance.
