HYDERABAD: A day after the Juvenile Justice (JJ) Board ordered trial of the four children in conflict with law (CCL) as adults in the Jubilee Hills minor girl gang-rape case, police are planning to request for speedy trial against the them.
On Friday, the JJ Board had recommended trial of the four CCL as adults and transferred their case record to the court of XII additional metropolitan sessions judge, Nampally (Children's Court) by invoking the Section 18 (3) of the JJ Act.
Public prosecutor K Pratap Reddy, who had earlier handled a case in the Children's Court where a CCL was tried as an adult and sentenced to life imprisonment for sexually assaulting and killing a minor, said the first step after the transfer of the case, the Children's Court would call the four CCL for examination. "After informing that they have been charged under particular sections of law, the court will ask the CCL how do they plead. If the CCL plead not guilty, then a schedule for the trial will be issued. To begin with, statements of the listed witnesses will be recorded," the public prosecutor added.
Police said that the four CCL could appeal before the session's court against the JJ Board's order under Section 101 (2) of the JJ Act. As per the Act, "The court of sessions may, while deciding the appeal, take the assistance of experienced psychologists and medical specialists other than those whose assistance has been obtained by the Board in passing the order under the said section."
Jubilee Hills police said that they would file a memo before the session's court seeking a speedy trial in the gang-rape case.
The five accused, including four CCL, have allegedly gang-raped the minor girl in a parked car at an isolated place near Peddamma Temple on May 28. The sixth accused, son of a legislator, has been booked for allegedly outraging the modesty of the girl. All the accused were currently out on bail.
