Court relieves residents’ association from clutches of promoter
Coimbatore: The residents of a retirement community at Pachapalayam heaved a sigh of relief after the principal district munsif court on Wednesday nullified an agreement entered by them with the promoter of the property on providing common services.
There are 126 individual villas in the retirement community - Soundarayam And Santhosham. It came into existence in 2006. The size of each villa ranged from 1,000 sq ft to 3,000 sq ft.
Eight years ago, the residents of the community sought legal remedy after the promoter charged exorbitantly for common services such as the dining hall, medical centre, library and multipurpose hall.
On Wednesday, the principal district munsif court in its order nullified the agreement on common services entered between the owners of the 126 villas and the promoter. The court instructed the promoter to form a society involving the owners so that they can function independently.
The court also said that the promoter should transfer the title suit of the land and common facilities in favour of the society within a month from the date of registration of it. Until then, it has been asked to continue the service.
An office-bearer of Soundaryam, Santhosham Residents Welfare Association said that although the services of the promoter were decent, the price it charged was exorbitant. “Villa owners were charged 12 per square foot,” he said.
