Amanatullah case: Judge poses tough questions to investigators; prosecution invokes Hansie Cronje

Hearing AAP MLA Amanatullah Khan’s bail plea on Tuesday, a Delhi judge posed some tough questions to the anti-corruption branch, asking what exactly was the loss in the case of alleged irregularities in the Delhi Waqf Board case and what was the criminality involved.

Special Judge Vikas Dhull is expected to pass his order on the bail plea on Wednesday.

During the hearing, the judge asked questions on the allegations that some properties under the board have been rented out “arbitrarily” and that the “benefit” is being reaped by Khan and those close to him.

When the prosecution was trying to explain why it had invoked the pertinent sections against Khan, the judge, while dealing with the question of misappropriation of funds, said, “This misappropriation? How it has come to him (Khan)? Did you take statement of those people that he took the money (from)?” the judge said.

Additional Public Prosecutor Atul Shrivastava, who appeared on behalf of the agency, chose to cite the example of former South African cricketer Hansir Cronje’s match fixing scandal to argue that even though money may not have been cheated but “cheating was made out” since people purchased tickets to “watch a match which was fixed”. Anand Mohan J reports

Saplings being planted in bulk to achieve targets, no record of survival: Plea in Delhi HC

The Delhi High Court Tuesday issued notices to the Delhi government, Ministry of Environment, Forest and Climate Change and Delhi Development Authority (DDA) in a public interest litigation (PIL), which states that bulk/single-day plantations are done by public authorities in the national capital to “achieve numerical targets”. The plea seeks an SIT probe to ascertain the number and kind of saplings planted in Delhi in the last five years, the costs incurred, and the survival.

The counsel for the petitioner, Akash Vashishtha, argued that none of the agencies that conducted plantations were maintaining proper records regarding the species, numbers, exact areas, geotagged locations, costs involved and survival.

“No information pertaining to the plantations are made publically available on their websites, not allowing a common citizen to view such important information and participate or to provide feedback. The grim survival rate is primarily because of the wrong method, single-day bulk plantations; invasive species are planted instead of native ones which is destroying the city’s biodiversity,” Vashishtha submitted. Malavika Prasad reports

Delhi HC asks DDA counsel to seek instructions on suo motu petition over death of 2 men in sewer

The Delhi High Court Tuesday asked the counsel appearing for Delhi Development Authority (DDA) to seek instructions from their client in a suo motu petition pertaining to the death of a sweeper and a security guard in Mundka after they inhaled toxic gases inside a sewer.

The petition was listed before a bench comprising Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad when the counsel appearing for the DDA submitted that she had received notice of the matter Monday and prayed for time to seek instructions on the same. The high court allowed the counsel for the DDA to seek instructions and the matter is now listed on October 6.

During the course of the hearing, the Court asked which agency in the particular area where the incident occurred is responsible for the sewage, and was informed by the parties that it was the DDA. The Court observed that the matter pertains to the death of a “poor scavenger” wherein “despite laws they are being forced to do all this”. The counsel appearing for the Delhi Government submitted that the executing agency should be made liable, as they were not providing supervisors. Read the full report here
