THANE: The Thane sessions court granted bail to three accused in an attempt to murder case registered with the Chitalsar police station.
The defence counsel Ambrish Jadhav said that the case pertains to an incident that took place on June 06, 2022 at around 8.30pm where in one victim Chandan Gupta was attacked with sword and other lethal weapons by a group at Vasant Vihar over a previous enmity. A total of 24 persons were booked and the trio moved the bail.
Adv Jadhav argued that the investigation was a faulty and conducted in a biased manner. The investigating machinery had also filed a report under section 169 (release of accused when evidence deficient) of the CrPC against the main accused who was actively involved in the crime. Also injury certificate was of private hospital and certified by BUMS doctor.
Although the entire incident was captured on CCTV footage faces of none of the accused persons were seen clearly also no proper test identification parade of the alleged accused was conducted. Thus the entire case is false and manipulated.
The judge PM Gupta in its order observed that the investigation officer has not presented the medical report of the government hospital where the injured was treated. The charge sheet in the case is already filed in the court.
"As per the charge sheet the applicant and the accused (already) released on bail have played almost similar role in commission of crime. Thus, on the ground of parity the accused is entitled to be released on bail. His further incarceration in this case is unwarranted," the judge noted in the order.
The judge also allowed the pre arrest bail plea by another alleged accused Lokesh Vijay Ravji.
