Noida: 75-year-old gets life term for digital rape of a minor

NOIDA: A 75-year-old man has been sentenced to life imprisonment for digital rape of a 3-year-old girl in Sector 39 police station area in 2019. The man, Akbar Ali, is from Malda in West Bengal.
Digital rape involves forcefully inserting one's fingers into the private parts of an individual without consent.
Neetu Bishnoi, special public prosecutor, said the girl's father had filed a police complaint on January 21, 2019. "The complainant said at 11 am that day, his daughter was playing outside her home. Akbar lured her with toffee and took her to his room."
The complainant said, "My daughter came home crying and revealed her ordeal to her mother."
Police said that Akbar lived at his son-in-law's home in the neighbourhood. No one was at home when he committed the crime.
The girl testified in court that she was playing outside when Akbar lured her to his room with toffee and sexually assaulted her.
Dr Pushplata, who conducted the medical examination, in her report said, "There was no injury mark on the private part... In my medical report, any rape can't be confirmed with medical inspection. The internal inspection of the victim was found to be normal," she said.
Akbar's granddaughter, a defence witness, said that her family had cooked meat two days prior to the incident and dumped the bones in the neighbourhood, which led to a quarrel with the girl's family. "The complaint registered is a false case against my grandfather," she said.
The court relied on the testimonies of the girl and her parents and convicted Akbar to life imprisonment under the Pocso Act and fined him Rs 50,000. "Out of the amount of fine imposed, 80% shall be paid to the girl for trauma, pain and suffering as she is entitled under Section 357-A of the CrPc," the court said.
Akbar's lawyer Irshad Ali said that he was not satisfied with the judgment. "The medical report did not establish rape or assault. We will challenge this order in high court," he said.
