Hearing in the case of Shri Krishna Janmbhoomi Mathura and Shahi Idgah complex has been held in Allahabad High Court on Monday.
The High Court has directed the Mathura District Court to decide the petition filed within four months for the demand of survey by appointing the court commissioner of the royal Idgah complex on behalf of Shri Krishna Janmabhoomi's party Manish Yadav. On behalf of the temple side, Harshit Gupta and Ramanand Gupta presented their side in the court. The single bench of Justice Piyush Agarwal has passed this order while hearing the petition.
Significantly, a petition has been filed on behalf of the temple side in the Mathura District Court demanding a scientific survey of the Mathura Shri Krishna Janmabhoomi and the Shahi Idgah complex. Due to the long pending petition in the Mathura District Court, the petitioner Manish Yadav moved the Allahabad High Court.
A petition was filed in the High Court on behalf of the temple side saying that the petition seeking scientific survey of the Shahi Idgah complex and the temple complex in District Court Mathura is pending, directed the High Court to dispose of the petition after hearing the District Court at the earliest.
Hearing the petition, the High Court has directed the District Court to decide the application filed in the Mathura Court within four months. Along with the temple side, the lawyers of the Waqf Board and Shahi Idgah Committee also appeared in the court.
It is worth mentioning that Manish Yadav, president of Narayani Sena, has described 13.37 acres of land of Shri Krishna Janmabhoomi as encroachment on the Idgah built on that land, while describing it as a temple trust. Earlier on August 8, in the court of Civil Judge itself, in the case of Pankaj Singh, the court dismissed his case after the secretary of the Idgah Arrangement Committee and advocate Tanveer Ahmed objected to his continued absence. Pankaj Singh had also called the Idgah built on that land as encroachment.
Earlier on August 3, the Allahabad High Court had stayed the hearing of a case related to seeking permission for worship at the 'real birthplace' of Lord Krishna in Mathura. This case is going on in the lower court and the birthplace of Lord Shri Krishna is allegedly in the possession of the Trust Masjid Idgah.
In the Shri Krishna Janmabhoomi Shahi Masjid Idgah dispute, Dinesh Sharma, the National Treasurer of the Akhil Bharat Hindu Mahasabha, filed a petition in the court of Civil Judge (Senior Division) Jyoti Singh on May 18, 2022, asking the court to perform the jalabhishek of Laddu Gopal in the Shahi Masjid Idgah. After hearing the arguments, the judge dismissed the petition.
The court in Varanasi had ordered survey and videography in the Gyanvapi-Shringar Gauri case. After which the Shivling was claimed to be found in the Vazukhana of the mosque. Its report was submitted by the court commissioner to the court. Now there is a demand to conduct survey and videography in Shri Krishna Janmasthan-Shahi Idgah case.
