HYDERABAD: The Registrar of Companies (
ROC), Hyderabad, has issued strike-off notices to 4,399 companies in Telangana for not filing business commencement reports within the stipulated period.
The ROC issued 13,560 notices for directors and the 4,399 companies, giving them one month to respond. Section 10A of the Companies Act mandates filing a declaration on commencement of business within 180 days of incorporation of the company, said ROC (Hyderabad) V E Josekutty. Only certain companies under Section 8 (non-profit), vanishing companies, pending inspection or investigation, companies that committed fraud after taking deposits and those facing charges are exempted from this rule.
The ROC took similar action in 2019 and 2021. It had earlier struck off 6,292 companies in Telangana for not filing annual reports and balance sheets which is mandatory under the Act. Officials said directors could be disqualified for five years if the company fails to file annual reports and balance sheets for three years.
RoC has also cracked the whip against Chineselinked loan app companies and sent reports to the Ministry of Corporate Affairs (MCA), asking agencies such as the Enforcement Directorate (ED) to take action. The ED has attached cash reserves of these loan app companies worth hundreds of crores. Hyderabad Central Crime Station (CCS) has also booked several cases against these loan app companies with Chinese links.
The RoC has also set up a separate Chinese cell to investigate these companies. Different agencies including Enforcement Directorate, Central Bureau of Intelligence and Intelligence Bureau have been collecting information regarding Chinalinked companies in the past few months.
This is not the first time the Registrar of Companies, Hyderabad has taken action against companies in Telangana for not filing annual reports.
